1. Acceptance of Terms

By accessing or using GeoTVclub (“we”, “our”, “us”, or the “Service”), available at https://geotvclub.com, you (“you” or “User”) agree to be legally bound by these Terms & Conditions (“Terms”). If you do not agree to these Terms, you must not access or use the Service.

If you are entering into this agreement on behalf of a company or organization, you represent and warrant that you have the authority to bind such entity to these Terms.

2. Eligibility

To use the Service, you must:

  • Be at least 18 years old or the age of majority in your jurisdiction (whichever is greater);
  • Have the legal capacity to enter into binding agreements;
  • Not be prohibited from using the Service under any applicable law;
  • Not have had your account previously suspended or terminated for violating our policies.

By using the Service, you represent and warrant that you meet these eligibility requirements.

3. Permitted and Prohibited Conduct

Permitted Use:

You agree to use the Service only for lawful purposes and in accordance with these Terms. You may:

  • Access and view publicly available content;
  • Create and manage a personal account;
  • Share your own original user content (subject to Section 6);
  • Use interactive features as intended.

Prohibited Conduct:

You may NOT:

  • Violate any law, regulation, or third-party rights;
  • Upload, share, or transmit any unlawful, defamatory, abusive, obscene, or otherwise objectionable content;
  • Infringe any intellectual property or proprietary rights;
  • Distribute viruses, malware, or harmful code;
  • Use automated scripts (e.g., bots, crawlers, scrapers) to access the Service without permission;
  • Attempt to gain unauthorized access to accounts, systems, or data;
  • Misrepresent your identity or affiliation;
  • Interfere with or disrupt the functionality of the Service or its security features.

We reserve the right to investigate and take legal action against any user who violates this section.

4. Intellectual Property Rights

All content on GeoTVclub, including but not limited to text, images, graphics, logos, videos, software, databases, layout, and trademarks, is the exclusive property of GeoTVclub or its licensors, and is protected by copyright, trademark, and other applicable intellectual property laws.

You may not copy, reproduce, distribute, modify, create derivative works of, publicly display, or exploit any part of the Service without our express written permission, except as explicitly allowed under these Terms.

5. User Accounts

You are responsible for:

  • Maintaining the confidentiality of your account login credentials;
  • Ensuring the accuracy of your account information;
  • All activities that occur under your account.

You agree to notify us immediately at john@mailbox10.com of any unauthorized use or suspected breach of security.

We reserve the right to suspend or terminate your account at our discretion.

6. User Content & License

By submitting, uploading, or posting any content to the Service (“User Content”), you grant GeoTVclub a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, adapt, publish, translate, display, distribute, and create derivative works of such content for any lawful purpose related to the operation and promotion of the Service.

You represent and warrant that:

  • You own or have the necessary rights to post the User Content;
  • The User Content does not infringe any third-party rights or violate any laws;
  • The User Content complies with these Terms.

We reserve the right to remove or restrict access to any User Content at any time, for any reason, without prior notice.

7. Disclaimers

The Service is provided on an “as-is” and “as-available” basis, without warranties of any kind, express or implied.

We disclaim all warranties, including but not limited to:

  • Merchantability or fitness for a particular purpose;
  • Accuracy, completeness, or reliability of content;
  • Uninterrupted or error-free access;
  • Freedom from viruses or harmful components.

Some jurisdictions do not allow disclaimers of implied warranties, so this provision may not apply to you in full.

8. Limitation of Liability

To the maximum extent permitted by law, GeoTVclub and its affiliates, directors, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or other intangible losses, arising from or relating to:

  • Your use or inability to use the Service;
  • Unauthorized access or alteration of your content or account;
  • Any conduct or content of third parties on the Service.

Our total liability to you for any claim shall not exceed the greater of:

  • $100 USD; or
  • The amount paid by you (if any) for access to the Service in the prior 12 months.

9. Indemnification

You agree to indemnify, defend, and hold harmless GeoTVclub and its officers, directors, employees, affiliates, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from or in any way related to:

  • Your access to or use of the Service;
  • Your User Content;
  • Your violation of these Terms;
  • Your violation of any rights of another.

10. Account Suspension or Termination

We may suspend or terminate your account and access to the Service, at our sole discretion, without prior notice, if:

  • You violate these Terms;
  • We are required to do so by law;
  • Your behavior is abusive, deceptive, fraudulent, or poses a security risk.

Upon termination:

  • Your right to access the Service will cease immediately;
  • We may delete or retain your content in accordance with our Privacy Policy.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law rules.

12. Dispute Resolution

A. Informal Resolution

Before initiating legal proceedings, you agree to attempt to resolve any dispute with us informally by contacting us at john@mailbox10.com within 30 days of the issue.

B. Formal Resolution

If informal efforts fail, any dispute arising under or related to these Terms shall be resolved:

  • In the courts of Ilocos Norte, Philippines, if jurisdictional requirements are met; or
  • Where applicable, under relevant international jurisdiction rules (e.g., GDPR, CCPA enforcement mechanisms).

You agree to waive any objections to venue or jurisdiction in these courts.

13. Modification of Terms

We reserve the right to modify these Terms at any time, at our sole discretion. When changes are made, we will update the Effective Date and, where appropriate, notify users via email or notice on the Website.

Your continued use of the Service after such changes constitutes acceptance of the updated Terms.

14. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, that provision will be severed, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy and any additional terms disclosed to you in connection with specific services, constitute the entire agreement between you and GeoTVclub concerning your use of the Service.
